1. INTRODUCTION
1.1 The purpose of this document is to regulate the GENERAL TERMS AND/OR CONDITIONS of the online Booking and Pre-Booking services of TURISMO 2000 S.R.L. with registered office in SAN VITO LO CAPO VIA DEL COUS COUS 54. The terms “You” and “User” are here used in reference to any individual and/or entity who for any reason accesses WWW.HOTELEGITARSO.IT or uses the services.
1.2 The use of such services implies full and unconditional acceptance and the validity of all individual terms and/or General Conditions, which will be considered as automatically incorporated into the agreement signed with HOTEL EGITARSO without the need for their written transcription here, including the most updated version of these terms and/or conditions.
2. PRE-BOOKING
2.1
The Hotel reserves the right to modify any online content at any time, for any reason, without notice and without the consent of others, and is not responsible for any damages that these may cause.
2.2
The Hotel strongly invites users to carefully read the information regarding the services offered as stated on the website
and in particular the terms and conditions before making a reservation, before accepting a proposal, and before using its services and, if these are not sufficiently exhaustive, invites you to ask for further clarification by sending your questions to the email address info@hotelegitarso.it. The Hotel is not responsible for any omitted, missing, incorrect, or inaccurate information in communications with the user regarding the services or performances offered and proposed, and refers to the website
available online for any clarification. The Hotel is also not responsible for the information provided on information channels not directly managed by the Hotel.
2.3 ANY SPECIAL REQUESTS MUST BE MADE AT THE TIME OF BOOKING. ALTHOUGH WE WILL DO OUR BEST TO MEET ALL REQUESTS, PROVIDED THEY ARE REASONABLE, WE CANNOT GUARANTEE THAT EVERY REQUEST WILL BE FULFILLED. WE CANNOT ACCEPT BOOKINGS WHERE A PARTICULAR CONDITION FOR FULFILLMENT OF A SPECIAL REQUEST IS SPECIFIED. ALL BOOKINGS WILL BE TREATED AS "STANDARD" BOOKINGS SUBJECT TO THE ABOVE PROVISIONS REGARDING SPECIAL REQUESTS.
2.4 IN CASE OF HEALTH PROBLEMS OR DISABILITIES THAT MAY AFFECT THE COURSE OF YOUR HOLIDAY, PLEASE INFORM US BEFORE CONFIRMING THE BOOKING. IF WE REASONABLY BELIEVE THAT WE CANNOT MEET THE PARTICULAR NEEDS YOU HAVE INDICATED, THE HOTEL RESERVES THE RIGHT TO CANCEL YOUR BOOKING IF IT IS UNABLE TO MEET YOUR REQUIREMENTS. BY MAKING A BOOKING, THE USER WAIVES ANY REQUEST FOR REFUND OR COMPENSATION IF THEY HAVE FAILED TO REPORT THE ABOVE REQUIREMENTS AT THE TIME OF BOOKING.
3.
BOOKING
3.1
The Hotel Egitarso has several accommodation facilities belonging to the Hotel called Dependance. The Dependance are three and are located in the area of San Vito Lo Capo, about 50 meters from the beach and 150 meters from the Hotel. The person who completes the booking declares to have read, understood, and accepted the characteristics regarding the booked accommodation, the services offered by the Hotel, and the payment and cancellation conditions, available online on the website
3.2
The Hotel offers the user the possibility to choose between several rates: refundable and non-refundable. By choosing a Non-Refundable rate, the user agrees to lose 100% of the amount paid at the time of booking in case of cancellation. By choosing a Refundable rate, the user agrees to lose 100% of the amount paid as a deposit at the time of booking in case of cancellation communicated beyond the free cancellation period mentioned in each booking. Refundable rates are free from restrictions during certain periods of the year. In high season, however, a minimum stay of three or seven nights may be required. By making a reservation, the user accepts the terms and conditions of the services and waives any request for refund or compensation resulting from the loss of the deposit/balance due to the cancellation policies. Payment can be made in cash, bank transfer according to the specified methods, credit/debit card or ATM card with Visa, Mastercard or Amex circuit. Payments by current account checks and cryptocurrencies are not accepted.
3.3
The Hotel reserves the right to unilaterally modify your reservation at any time, for any reason, without notice and without your consent and is not responsible for any damages that may result. However, if such unilateral modification, attributable to the Hotel's fault, results in a substantial change to the reservation, the Hotel undertakes to refund the lost service in whole or in part or to provide a solution of equal or better level. By making a reservation, the user accepts the terms and conditions of the services and waives any claim for compensation in the event of a modification to the reservation attributable or not attributable to the Hotel.
3.4
The Hotel reserves the right to unilaterally cancel your reservation at any time, for any reason, without notice and without your consent, and is not responsible for any damages this may cause. However, in the event of cancellation attributable to the Hotel's fault, it undertakes to refund the reservation or to provide accommodation of equal or higher standard. By making a reservation, the user accepts the terms and conditions of the services and waives any claim for compensation in the event of cancellation of the reservation, whether or not attributable to the Hotel.
3.5
Your reservation will only be binding following acceptance by Hotel Egitarso through its confirmation via e-mail and payment by the user. The user must check the booking confirmation and immediately report in writing to Hotel Egitarso any errors found. By making a reservation, the user accepts the terms and conditions of the services and waives any claim for compensation in the event of non-registration of the reservation, whether attributable or not to the Hotel. If you choose a payment method by bank transfer, the user is responsible for sending a copy of the completed transfer to the email address info@hotelegitarso.it and waiting for an email notification confirming the reservation from the Hotel. The Hotel is not responsible in case of missing or late confirmation email notification and it is the user's responsibility to inform the Hotel of the non-receipt of the confirmation email.
3.6
In case you wish to make changes to your reservation, you must notify us by contacting our booking center at info@hotelegitarso.it. The Hotel cannot guarantee that it will be able to meet every request for modification. Certain changes may be considered as cancellations and consequently subject to a penalty.
4.
DISCLAIMER OF WARRANTIES AND LIABILITY
4.1 HOTEL EGITARSO DOES NOT GUARANTEE THE RELIABILITY, AVAILABILITY OR CONTINUITY OF THE SERVICES OFFERED TO THE USER AND, CONSEQUENTLY, EXCLUDES ANY LIABILITY FOR ANY DAMAGES DUE TO LACK OF AVAILABILITY, RELIABILITY OR CONTINUITY OF ITS WEBSITE OR ITS SERVICES, HOWEVER IT WILL TRY TO FACILITATE, TO THE EXTENT OF ITS ABILITIES, TECHNICAL SUPPORT FOR THE PERSON IN QUESTION AND WILL TRY TO REMEDY ANY SERVICE INTERRUPTIONS IMMEDIATELY, IMPLEMENTING ALTERNATIVE MEASURES WITHIN ITS CAPABILITIES.
4.2 HOTEL EGITARSO DOES NOT AGREE TO CHECK AND DOES NOT HAVE PRIOR CONTROL OVER VIRUSES OR ELEMENTS, WITHIN ITS CONTENTS, THAT COULD ALTER THE USER'S OR VISITORS' SOFTWARE OR HARDWARE AND THEREFORE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND THAT MAY RESULT.
4.4
THE HOTEL IS NOT RESPONSIBLE FOR ANY COST OR ADDITIONAL EXPENSE INCURRED BY YOU OR IN THE EVENT THAT THE FULL OR PARTIAL USE OF OUR SERVICES IS LIMITED DUE TO THE OCCURRENCE OF "FORCE MAJEURE" CAUSES. IN THIS DOCUMENT RELATING TO BOOKING CONDITIONS, "FORCE MAJEURE" MEANS ANY EVENT THAT CANNOT BE FORESEEN OR AVOIDED BY US OR OUR SERVICE PROVIDERS, DESPITE ALL DUE CARE. SUCH EVENTS INCLUDE WAR OR SIMILAR EVENTS, RIOTS, CIVIL WARS, TERRORIST ATTACKS, NATURAL OR NUCLEAR DISASTERS, FIRES, ADVERSE WEATHER CONDITIONS, STRIKES, OR ANY OTHER EVENT BEYOND OUR CONTROL.
4.5 IT IS THE INTENTION OF HOTEL EGITARSO TO ARRANGE THE SERVICES YOU HAVE BOOKED WITH THE UTMOST CARE. WE WILL BE RESPONSIBLE FOR ANY SHORTCOMING THAT OCCURS DURING YOUR STAY, IN THE EVENT THAT THE CAUSE IS ATTRIBUTABLE TO A FAILURE ON OUR PART OR THAT OF OUR EMPLOYEES (PROVIDED THEY ARE ACTING WITHIN THEIR POWERS AND DUTIES AS EMPLOYEES). HOWEVER, IT WILL BE YOUR RESPONSIBILITY TO PROVE THAT THERE WAS INDEED A FAILURE ON OUR PART, SHOULD YOU WISH TO MAKE A COMPLAINT. WE WILL NOT BE RESPONSIBLE IN CASE OF ILLNESS, INJURY OR HARM, DEATH, LOSS OF ANY PERSONAL EFFECTS, DAMAGE, ADDITIONAL COST IN ANY OF THE FOLLOWING CASES:

OR (D) DUE TO THE LACK OF SOME THIRD PARTY THAT IS NOT DIRECTLY INVOLVED IN THE PROVISION OF SERVICES ON OUR BEHALF.
IN ADDITION, WE WILL NOT BE RESPONSIBLE FOR THE LACK OF ENJOYMENT OF YOUR STAY DUE TO YOUR FAILURE TO COMMUNICATE ANY IMPORTANT ELEMENT IN THIS REGARD AT THE TIME OF BOOKING OR NOT INCLUDED IN THE BOOKING CONTRACT.
IN PARTICULAR, WE WILL NOT BE RESPONSIBLE FOR ANY SERVICE THAT IS NOT EXPRESSLY INCLUDED IN THE CONTRACT.
5. HOTEL STAY
5.1
The delivery of keys at check-in is available from 2:00 pm to 4:00 pm. Any late-night arrivals must be reported to the Hotel. Rooms, apartments, and the Hotel garage must be vacated by 10:30 am on the day of departure. Only if available and with prior authorization from management, it is possible to keep the room in the afternoon by paying a supplement of 40% of the cost of one night.
5.2
It is forbidden to host unregistered persons in the room upon arrival. The hotel accepts small pets if notified before arrival.
The hotel does not accept unaccompanied minors on the premises.
5.3
The Hotel reserves the right to warn, remove, and report to the authorities those who violate the Hotel regulations, threaten its order, safety, peace, the normal conduct of activities, or hinder the enjoyment of services by other guests. The Hotel may also suspend services to the person concerned without any guarantee of refund. The guest waives any claim for refund or compensation in the event of suspension of services or cancellation of the reservation due to any of the aforementioned violations.
5.4
AT THE TIME OF BOOKING, YOU ACCEPT RESPONSIBILITY FOR ANY DAMAGE OR LOSS CAUSED BY YOURSELF. FULL AND IMMEDIATE PAYMENT WILL BE REQUIRED FOR ANY DAMAGE OR LOSS CAUSED, DIRECTLY TO THE MANAGER OF HOTEL EGITARSO. IF YOU FAIL TO DO SO, YOU WILL BE LIABLE FOR ANY LEGAL ACTION TAKEN AGAINST YOU AND YOU WILL BE REQUIRED TO PAY IN FULL FOR OUR LEGAL COSTS AND ANY COSTS OF THIRD PARTIES INVOLVED.
6. PROBLEMS AND COMPLAINTS
IN THE EVENT THAT YOU HAVE ANY REASON TO MAKE A COMPLAINT OR NEED TO REPORT ANY PROBLEM THAT HAS OCCURRED, YOU ARE REQUIRED TO IMMEDIATELY INFORM THE SERVICE STAFF. MOST PROBLEMS CAN BE RESOLVED QUICKLY.
7. GENERAL CONDITIONS FOR SUPPLIERS
SOME OF THE SERVICES THAT MAKE UP YOUR HOLIDAY ARE PROVIDED BY SUPPLIERS INDEPENDENT FROM THE HOTEL. THESE SUPPLIERS PROVIDE SUCH SERVICES ACCORDING TO THEIR OWN GENERAL TERMS OF SALE. THEREFORE, HOTEL EGITARSO IS NOT RESPONSIBLE
8. PRIVACY
THIS PAGE DESCRIBES THE METHODS OF MANAGING THE SITE WITH REFERENCE TO THE PROCESSING OF PERSONAL DATA OF USERS WHO CONSULT IT.
